Benjamin Moore & Co Online Customer Feedback Survey Sweepstakes Official Rules

NO PURCHASE NECESSARY. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.

1. Eligibility:

Benjamin Moore & Co Online Customer Feedback Survey Sweepstakes (the "Sweepstakes") is open only to legal residents of the fifty (50) United States (including District of Columbia) and Canada, who are eighteen (18) years of age or older at the time of participation and have completed the Online Customer Feedback Survey. Void where prohibited by law. Employees, officers, directors of Benjamin Moore ("Benjamin Moore & Co") and any entity associated with the administration and promotion of the Sweepstakes ("Administrator"), as well as the immediate family (spouse, parents, siblings, and children) and household members (people who share the same residence at least three (3) months out of the year) of each such employees are not eligible. The Sweepstakes is subject to federal, provincial, state and local laws and regulations.

3. Agreement to Official Rules:

Participation in the Sweepstakes constitutes a participant's full and unconditional agreement to and acceptance of these Official Rules and the decisions of the Benjamin Moore & Co, which are final and binding. Winning a prize is contingent upon fulfilling all requirements set forth herein.

4. Sweepstakes Period:

You may be eligible for entry (as defined below) into the Sweepstakes between 12:00 AM ET on January 1st 2011 and 11:59:59 PM ET on January 1st, 2012 (the "Sweepstakes Period").

5. To Enter:

For a chance to win during the sweepstakes period, provide your name, address, email and telephone number on the website, www.benjaminmoore.com/survey. Submitting an entry is free. Limit: one (1) entry per store receipt. All entries must be received within the Sweepstakes Period.

6. Selection of Sweepstakes Winner:

The Online Customer Feedback Survey Sweepstakes is sponsored by Benjamin Moore & Co. The prize winner of the Online Customer Feedback Survey Sweepstakes will receive: A $500 Visa Gift Card. (Retail Value ("AVR") is $500. Quarterly, Benjamin Moore & Co will at random select a winning entry based on all eligible entries received in the United States and Canada. Each winning entry will be declared a prize winner subject to verification of eligibility and compliance these rules. Each potential prize winner will be contacted by Benjamin Moore & Co. decisions are final and binding on all matters regarding the Sweepstakes.

7. Verification of Potential Winners:

Potential winners must continue to comply with all terms and a condition of these Official Rules. Each potential prize winner will be required to sign and return to Benjamin Moore & Co, within seven (7) days of the date notice is sent, an Affidavit (or, if applicable, a Declaration for a Canadian winner), of Eligibility, and Liability/Publicity Release (except where prohibited) in order to claim his/her prize. If a potential winner cannot be contacted, fails to sign and return the Affidavit of Eligibility and Liability/Publicity Release within the required time period, or if the prize or prize notification is returned as undeliverable, potential winner forfeits prize. If the prize is forfeited, the next randomly selected entry will be declared the prize winner, subject to confirmation in accordance with these Official Rules. In order to be awarded a prize for the Sweepstakes ,an eligible entrant who is a potential winner of a prize and is a resident of Canada must correctly answer a mathematical, time-limited, skill-testing question (the "Skill-testing Question"), without assistance of any kind, whether electronic, mechanical or other. If any potential winning eligible entrant fails to correctly answer the Skill-testing Question, he/she shall forfeit the prize to which he/she may otherwise have been entitled, without recourse to Benjamin Moore & Co.

8. Prizes:

Prize Winner: There is one (1) drawing per quarter in the United States and (1) drawing per quarter in Canada. The prize winner of the Online Customer Feedback Survey Sweepstakes will receive: A $500 Visa gift card. The Retail Value ("ARV") of the prize is $500 U.S/Canadian. Odds of winning the drawing prize depend on the number of eligible entries received. Prizes are non-transferable and no substitution will be made except as provided at the Benjamin Moore & Co sole discretion. Benjamin Moore & Co reserves the right to substitute any listed prize for one of equal or greater value for any reason. Winners are responsible for all taxes and fees associated with prize receipt and/or use.

9. Ownership and Publicity Rights:

Winner agrees that Benjamin Moore & Co has the unrestricted, irrevocable right to use the Winner's name, likeness, hometown and state (a "Likeness") in any and all media now existing or hereafter discovered or developed, for any and all purposes including, without limitation, advertising, promotion, entertainment and commercial purposes, without additional consideration to, or further authorization by, the Winner.

10. General Conditions:

In the event that the operation, security, or administration of the Sweepstakes is impaired in any way for any reason, including, but not limited to fraud or other technical problem, the Benjamin Moore & Co may, in its sole discretion, either: (a) suspend the Sweepstakes to address the impairment and then resume the Sweepstakes in a manner that best conforms to the spirit of these Official Rules; or (b) award the prize in a random drawing of all eligible participants at the time of the impairment. Benjamin Moore & Co is only responsible for funding the prize set forth above. The Benjamin Moore & Co reserves the right at its sole discretion to disqualify any individual it finds to be tampering with the operation of the Sweepstakes or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and, should such an attempt be made, the Benjamin Moore & Co reserves the right to seek damages from any such person to the fullest extent permitted by law. Failure to enforce any term of these Official Rules shall not constitute a waiver of that or any other provision.

11. Release and Limitations of Liability:

By participating in the Sweepstakes, participants agree to release and hold harmless the Benjamin Moore & Co, its related companies, their respective officers, directors, employees, and agents, and anyone involved in the development or execution of this Sweepstakes (collectively, the "Released Parties") from and against any and all claims, liability or cause of action arising out of participation in the Sweepstakes or acceptance, use or misuse of a prize, including, but not limited to: (a) unauthorized human intervention in the Sweepstakes; (b) technical errors related to providers, or telephone or network lines; (c) printing errors; (d) lost, late, postage-due, misdirected, or undeliverable mail; (e) errors in the administration of the Sweepstakes; or (f) injury or damage to persons or property. The Released Parties do not make any warranty, representation or guarantee, express or implied, in fact or in law, relative to the use of any prize, including, without limitation, quality, merchantability, and fitness for a particular purpose. Except where prohibited, participant agrees that: (a) any and all claims, judgments and awards allowed under the Official Rules shall be limited to actual out-of-pocket costs incurred, including costs associated with participation in the Sweepstakes but in no event attorneys' fees; and (b) under no circumstances will participant be permitted to obtain awards for, and participant hereby waives all rights to claim, punitive, incidental and consequential damages and any other damages, and any and all rights to have damages multiplied or otherwise increased.

12. Disputes:

Participants agree that this Sweepstakes is governed solely by the substantive laws of the State of New Jersey, without regard to its conflicts of law rules. As a condition of participating, participant, except for residents of Quebec, agrees that any claims arising out of or relating to this Sweepstakes or any prize may be brought only in a federal or state court in New Jersey. If any provisions of these Official Rules are held to be invalid or unenforceable, all remaining provisions hereof will remain in full force and effect.

13. Privacy:

Benjamin Moore & Co collects personal information from you when you enter the sweepstakes. The information collected is subject to the privacy policy of Benjamin Moore & Co at www.benjaminmoore.com/privacy.

14. Results:

For the names of prize winners, please send a self-addressed stamped envelope to: Winners List - Benjamin Moore & Co. Online Customer Feedback Survey Sweepstakes c/o Benjamin Moore & Co., 101 Paragon Drive, Montale, NJ 07645, for receipt by February 1st, 2012. Canadian residents may omit return postage.
